1. Agreement to These Terms

These Terms of Service ("Terms") are an agreement between you and the operator of Pynov ("Pynov," "we," "us," or "our"):

By creating an account or using the Pynov website and application at getpynov.com (the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Pynov is a software tool that helps users create Pinterest content in batches. Based on a brief, prompt, product photos, and other inputs you provide, Pynov uses artificial intelligence to generate pin visuals and copy (titles, descriptions, and keywords), saves them to your History, and — when you choose a publishing mode and connect your Pinterest account — publishes or schedules pins to your Pinterest boards through Pinterest's official API.

The Service is provided over the internet and may change over time. Features, limits, and availability may vary by plan.

3. Eligibility and Accounts

• You must be at least 18 years old, or the age of legal majority where you live, and able to form a binding contract.
• You must provide accurate information when you create an account and keep it up to date.
• You are responsible for keeping your login credentials confidential and for all activity under your account.
• Notify us promptly at legal@getpynov.com if you believe your account has been accessed without authorization.
• One person or business may not maintain multiple free accounts to circumvent plan limits.

4. Acceptable Use

You agree that you will NOT:

• Use the Service for any unlawful purpose, or in violation of any applicable law or regulation.
• Upload, generate, or publish content that infringes any copyright, trademark, or other intellectual property right, or that violates any person's privacy or publicity rights.
• Upload or publish deceptive, fraudulent, or misleading content, including false product claims, fake reviews, or content designed to deceive consumers.
• Publish spam, or use the Service to send unsolicited bulk communications.
• Violate Pinterest's Terms of Service, Community Guidelines, or Developer and API policies (see Section 7).
• Attempt to access the Service by automated means other than the features the Service itself provides, or attempt to bypass plan limits, credits, or security measures.
• Probe, scan, or test the vulnerability of the Service, or interfere with its operation or infrastructure.
• Upload viruses or malicious code.
• Resell, sublicense, or provide access to the Service to third parties except as your plan expressly allows (for example, an Agency plan used to serve your own clients).

We may suspend or terminate accounts that violate this Section.

5. Your Content and the License You Grant Us

"Your Content" means everything you provide to the Service: briefs and prompts, product photos and other images you upload, destination links, text, and the boards and pins you create or manage through the Service.

• You keep ownership. As between you and us, you own Your Content, subject to any rights of third parties (for example, a product manufacturer's rights in its product photos).
• License to operate the Service. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, modify (for example, to format or resize images), display, and transmit Your Content solely as needed to provide the Service to you — including sending prompts and images to our AI providers for generation, and publishing or scheduling pins to your connected Pinterest account at your direction.
• Your responsibility. You represent that you own Your Content or have all rights and permissions needed to use it with the Service and to publish it on Pinterest, and that Your Content does not violate law or any third party's rights.
• Removal. You may delete Your Content within the Service. Deleting content from Pynov does not remove pins already published to Pinterest; you manage published pins in your Pinterest account.

6. AI-Generated Content

The Service uses third-party artificial intelligence models to generate images and text from your inputs.

• AI output can be inaccurate, unexpected, or similar to output generated for others. Generation saves results to History and never authorizes publication. Review each completed pin, including its image, text, destination and board. By selecting Publish or confirming Schedule for those saved pins, you authorize PYNOV to send only the pins you selected to the chosen connected Pinterest account and board. Scheduled delivery runs at the confirmed times while that connection remains active. You remain responsible for the content you choose to publish.
• As between you and us, and to the extent permitted by law, you own the content generated for you through the Service and may use it for your lawful business and marketing purposes, including commercial use on Pinterest.
• You are responsible for ensuring that generated content you publish complies with applicable law (including advertising and disclosure rules, such as disclosing affiliate relationships) and with Pinterest's policies.
• We do not guarantee that generated content is unique, and we are not responsible for claims arising from your publication of generated content that infringes a third party's rights where the infringement arises from your inputs or instructions.

7. Pinterest Integration

• Independent service. Pynov is an independent tool. Pynov is not affiliated with, endorsed by, sponsored by, or otherwise associated with Pinterest, Inc. "Pinterest" and related names and marks belong to Pinterest, Inc.
• Your Pinterest account. To publish, you connect your Pinterest account and authorize us to act through Pinterest's official API using the access tokens you grant. You may disconnect Pinterest at any time within the Service or from your Pinterest account settings; disconnecting stops future publishing but does not delete pins already published.
• Your obligations. Your use of Pinterest remains governed by Pinterest's own Terms of Service and policies. You are solely responsible for your Pinterest account, your boards, and everything published to them, and for any action Pinterest takes regarding your account (including warnings, limits, or suspension) arising from your content or conduct.
• No guaranteed results. Pinterest controls its own platform, algorithms, and enforcement. We do not control Pinterest and we do not guarantee impressions, traffic, sales, or any particular result from publishing, and we are not responsible for Pinterest outages, API changes, or Pinterest's decisions about your account or content.

8. Plans, Credits, and Payments

• Plans. Pynov offers a Free plan and paid subscription plans (currently Starter at $9 USD/month, Pro at $24 USD/month, and Agency at $49 USD/month). Plan features, credit allowances, image allowances, and batch limits are described on our website and in the Service, and may change as described in Section 14.
• Credits. Credits measure generation usage; they are not a fixed number of pins. The credit cost of a generation varies with generation type, image quality, and options (such as AI visual text). Credits and allowances reset or renew as described in your plan, have no cash value, are non-transferable, and unused credits do not roll over unless your plan expressly says so.
• Billing. Paid plans are billed in advance on a recurring monthly basis through our payment processor, Stripe. By subscribing, you authorize Stripe to charge your payment method for the plan price plus any applicable taxes, and to charge it again at each renewal until you cancel. We do not receive or store your full card number; payment information is collected and processed by Stripe under Stripe's own terms and privacy policy.
• Renewals and price changes. Your subscription renews automatically at the then-current price. If we change a plan's price, we will give reasonable advance notice and the new price will apply from your next renewal; if you do not agree, cancel before that renewal.
• Failed payments. If a charge fails, we may retry it, and we may downgrade, suspend, or limit your account until payment succeeds.

9. Cancellation and Refunds

• How to cancel. You may cancel a paid plan at any time from your account/billing settings in the Service or through the Stripe billing portal, or by contacting us at legal@getpynov.com. Cancellation takes effect at the end of the current billing period; you keep your paid features until then, and your account continues on the Free plan (subject to Free plan limits) unless you delete your account.
• Refund policy. AI generation and related infrastructure create real processing costs as soon as a generation runs. For that reason, refunds are generally not provided — in particular, there are no refunds for credits or quota already consumed, outputs already generated, or dissatisfaction with business results. Exception — billing errors: if you were charged in error (for example, a verified duplicate charge, an incorrect plan charge, or another technical billing mistake), contact us and we will correct the charge or refund it as appropriate.
• Requesting a review. Send refund or billing review requests to legal@getpynov.com, including your account email, the charge date, your plan, and the reason for the request. We may ask for additional information to verify the issue.
• This Section is consistent with, and supplemented by, the Refund Policy published on our website.

10. Our Intellectual Property

The Service itself — including its software, design, interface, text, graphics, logos, and the "Pynov" name and marks — belongs to us or our licensors and is protected by intellectual property laws. These Terms do not grant you any right to our intellectual property except the right to use the Service as provided. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service except where law gives you that right.

If you send us feedback or suggestions, you grant us the right to use them without restriction or payment to you.

11. Third-Party Services

The Service relies on third-party providers, including Firebase/Google (hosting, authentication, and database), OpenAI (AI generation), Pinterest (publishing), Stripe (payments), and Vercel (hosting/delivery). Your use of those features is also subject to the third parties' own terms, and we are not responsible for third-party services, their availability, or their acts or omissions.

12. Disclaimers

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
• We do not warrant that the Service will be uninterrupted, error-free, or secure, or that generated content will be accurate or suitable for any purpose.
• No earnings or performance guarantee. Pinterest results depend on your content, audience, and strategy. We make no promise of traffic, revenue, or business results.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising from or related to your use of the Service — including any action Pinterest takes on your account, and any claim arising from content you create, generate, or publish through the Service.
• Our total liability for all claims arising from or related to the Service will not exceed the greater of (a) the amounts you paid us in the twelve (12) months before the claim arose, or (b) USD $100.
• Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Indemnification

You agree to indemnify and hold us harmless from third-party claims, damages, and reasonable expenses (including attorneys' fees) arising from: your content; your use of the Service in violation of these Terms or of law; your Pinterest account and anything published to it through the Service; or your infringement of any third party's rights.

15. Suspension and Termination

• You may stop using the Service and delete your account at any time.
• We may suspend or terminate your access if you violate these Terms, if your payments fail, or if we are required to do so by law. Where reasonable, we will give notice and an opportunity to cure before termination for a curable violation.
• On termination, your right to use the Service ends. Content already published to Pinterest remains governed by Pinterest and your Pinterest account. Sections that by their nature should survive (including Sections 5, 10, 12, 13, and 14) survive termination.

16. Changes to the Service and to These Terms

We may update the Service and these Terms from time to time. If we make material changes to these Terms, we will give reasonable notice (for example, by posting the updated Terms in the Service or on our website, or by email) before they take effect. Changes apply prospectively. By continuing to use the Service after the effective date of updated Terms, you accept them; if you do not agree, stop using the Service and cancel before the changes take effect.

17. Governing Law and Disputes

• Governing law. These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law principles.
• Venue. Any dispute arising from or related to these Terms or the Service will be resolved in the state or federal courts located in Miami-Dade County, Florida, and the parties consent to the personal jurisdiction of those courts.
• If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.
• These Terms (with the Privacy Policy) are the entire agreement between you and us regarding the Service and supersede prior understandings on the same subject.
• You may not assign these Terms without our consent; we may assign them in connection with a sale or reorganization of the business operating the Service.
